Introduction

Welcome to Rolevate. These Terms of Service ("Terms") govern your access to and use of Rolevate's AI-powered recruitment platform, including our website, mobile applications, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use our services.

Acceptance of Terms

By creating an account, accessing, or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and Cookie Policy. These Terms constitute a legally binding agreement between you and Rolevate.

Eligibility

You must be at least 16 years of age to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Account Registration and Security

To access certain features of the Platform, you must create an account. When you register, you agree to:

Provide accurate, current, and complete information during registration and keep your account information up to date.
Maintain the security of your password and accept all risks of unauthorized access to your account.
Notify us immediately if you suspect any unauthorized use of your account or security breach.
Take responsibility for all activities that occur under your account, whether or not authorized by you.

User Types and Platform Services

Rolevate serves two primary user types, each with distinct features and obligations:

For Job Seekers (Candidates)

Create and maintain a professional profile, including uploading your CV, work history, and skills.
Browse and apply to job openings posted by employers.
Participate in AI-conducted voice interviews as part of the application process.
Track your application status and receive notifications about opportunities.

For Employers

Post job listings and define required qualifications and skills.
Use AI-powered screening and interview tools to evaluate candidates at scale.
Review AI-generated assessments, interview transcripts, and candidate profiles.
Manage your recruitment pipeline, collaborate with team members, and make hiring decisions.

AI Interview System and Consent

Rolevate uses artificial intelligence to conduct structured voice interviews with job applicants. By using the Platform as a candidate, you explicitly consent to the following:

You agree to participate in AI-conducted voice interviews as part of your job applications.
Your interview responses will be recorded, transcribed, and analyzed by AI algorithms to assess your fit for the role.
AI-generated assessments, scores, and recommendations will be shared with prospective employers.
AI assessments are tools to assist hiring decisions and do not guarantee employment outcomes. Final hiring decisions rest with employers.

User Conduct and Prohibited Activities

You agree to use the Platform responsibly and in compliance with all applicable laws. You may not:

Provide false, misleading, or fraudulent information in your profile, CV, or during interviews.
Upload or transmit viruses, malware, or any harmful code that could damage the Platform or other users.
Engage in discriminatory, harassing, or abusive behavior toward other users.
Infringe on the intellectual property rights of Rolevate or third parties.
Attempt to disrupt, interfere with, or compromise the security or integrity of the Platform.
Use automated tools (bots, scrapers, etc.) to access or extract data from the Platform without permission.
Impersonate another person, entity, or Rolevate representative.
Violate any applicable local, national, or international laws or regulations.

Intellectual Property Rights

The Platform, including its design, code, logos, trademarks, AI models, and content, is owned by Rolevate and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Platform without our express written permission.

You retain ownership of the content you submit to the Platform, including your CV, application materials, and interview responses. However, by uploading content, you grant Rolevate a worldwide, royalty-free, non-exclusive license to use, store, process, and display your content for the purpose of operating the Platform and providing our services.

Employers who access candidate profiles and interview data are granted a limited license to use such data solely for recruitment purposes in accordance with these Terms and applicable data protection laws.

Payment, Subscription, and Billing

Certain features of the Platform, particularly for employers, require payment of subscription fees or usage-based charges. Payment terms are as follows:

Fees: Subscription plans and pricing are displayed on our website. All fees are exclusive of taxes unless otherwise stated.
Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually) and renew automatically unless canceled.
Refunds: Subscription fees are generally non-refundable, except as required by law or at our sole discretion.
Cancellation: You may cancel your subscription at any time. Cancellations take effect at the end of the current billing cycle, and you will not be charged for subsequent periods.

Privacy and Data Protection

Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, store, and protect your personal data. By using the Platform, you consent to our data practices as described in the Privacy Policy. We are committed to safeguarding your information and complying with applicable data protection laws, including GDPR and other relevant regulations.

Disclaimers and Warranty Limitations

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Rolevate does not guarantee that the Platform will be uninterrupted, error-free, or secure. We do not warrant the accuracy, completeness, or reliability of AI-generated assessments or any content on the Platform. Employers are solely responsible for their hiring decisions, and candidates are responsible for the accuracy of their application materials.

Limitation of Liability

To the maximum extent permitted by law, Rolevate, its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of the Platform. Our total liability for any claims related to the Platform shall not exceed the amount you paid to Rolevate in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless Rolevate, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform, (b) your violation of these Terms, (c) your violation of any third-party rights, including intellectual property or privacy rights, or (d) any content you submit to the Platform.

Termination and Suspension

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including but not limited to violation of these Terms, fraudulent activity, or misuse of the Platform. Upon termination, your right to use the Platform will immediately cease. You may also terminate your account at any time by contacting us. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, liability limitations, and dispute resolution) will remain in effect.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Jordan, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Amman, Jordan.

Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Platform, you agree to first attempt to resolve the matter informally by contacting us at [email protected]. If the dispute cannot be resolved within thirty (30) days, either party may pursue legal remedies in accordance with the Governing Law section above.

Changes to These Terms

We reserve the right to modify or update these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page and notify you via email or through a notice on the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Platform and terminate your account.
